The Unite Union took Birmingham City Council to the High Court to challenge the 106 redundancy notices sent out to staff – 2 weeks after a deal was allegedly made through ACAS by the former leader of Birmingham City Council Cllr John Clancy to take the job cuts out of plans to change waste management services.
During the verdict earlier today (20/09), Mr Justice Fraser read out a leaked email detailing why the Cllr John Clancy ‘acted above his authority’ to promise keeping grade 3 leading hand roles and how he didn’t consult with senior council officials.
The court heard in July refuse workers had begun industrial action and the dispute was continuing. Mr Justice Fraser described the case as ‘remarkable’ and ‘highly unusual’.
Unite will now pause its industrial action, while those jobs are saved for the time being.
A full trial between Birmingham City Council and Unite will begin in November.
